As a reminder, the Law “On Compulsory Civil Liability Insurance for Vehicle Owners” took effect on January 1, 2025.
This law introduces a gradual increase in insurance coverage limits to the European minimum coverage amounts set forth in Directive 2009/103/EU, which are 250,000 UAH for property damage in a traffic accident per victim (1.25 million UAH per incident) and 500,000 UAH for bodily injury per victim (5 million UAH per incident).
The current law provides for the elimination of paper-based contracts and their replacement with electronic contracts concluded through a single centralized database.
Starting January 1, 2025, direct settlement—which was previously offered only by some insurance companies—will become mandatory for all insurers providing auto liability insurance. Direct settlement will also be possible even if the at-fault party does not have a policy. This allows the victim to file a claim for insurance benefits with their own insurer, from whom they purchased the policy.
The main change regarding compensation for vehicle damage is that insurance payouts will now be calculated without taking vehicle depreciation into account. This means that the amount of compensation will be calculated based on the prices of new parts, ensuring fairer compensation for owners of damaged vehicles.
The process of settling insurance claims is also being expedited. From now on, decisions on insurance payments will be made more quickly.
The new law requires insurance companies to reduce the statutory decision-making period to 60 days. This means that victims will be able to receive insurance payments more quickly, which will significantly reduce financial pressure and stress in the event of a traffic accident.
However, if necessary, this period may be extended to 90 days, but only in specific cases provided for by law.
Thus, despite the increase in the cost of insurance policies, these legislative changes should significantly improve the motor vehicle insurance sector. They will make this sector more transparent and understandable for customers and truly ensure full compensation for damages, as required by the general provisions of civil law.
