The parties have a duty to disclose materials; this applies first and foremost to the investigation, which must provide the defendant and his or her attorney with access to the evidence of guilt that has been gathered. This is one of the most successful innovations of the 2012 Code of Criminal Procedure. However, since its implementation, the investigative authorities have developed a number of tactics, including ways to carry out “familiarization without actual familiarization.”

So what are the secrets to working with case materials, disclosing evidence to the prosecution, and how can you avoid getting lost in volumes of “paperwork”?
