LAWYERS AT BARRISTERS, LLC DENYS PONOMARENKO, YURI ZHOVTAN, AND IVANNA BLOKHINA EFFECTIVELY DEFENDED THE CLIENT’S RIGHTS AND LEGITIMATE INTERESTS

On December 21, 2021, in response to the attorneys’ motion to enforce the investigating judge’s ruling, the prosecutor issued a ruling to dismiss the criminal proceedings pursuant to paragraph 3 of Part 1 of Article 284 of the Criminal Procedure Code of Ukraine regarding a client of BARRISTERS LLP “BARRISTERS,” in which the pretrial investigation had been conducted by investigators of the National Police since 2015.

Thus, by a ruling of the investigating judge of the Primorsky District Court of Odessa dated October 26, 2021, upon the lawyers’ motion, the investigator was given and the prosecutor a period of two months from the date of the ruling to complete the pretrial investigation of the aforementioned criminal proceedings and to make a decision as provided for in Article 283 of the CPC.

Keeping a person in a state of uncertainty regarding the outcome of the criminal proceedings against them, without taking action within the shortest (reasonable) time to close such criminal proceedings or to refer the indictment to court—constitutes a violation of that person’s rights and freedoms guaranteed by the Convention for the Protection of Human Rights and Fundamental Freedoms.
