On October 26, 2018, as part of a memorandum of cooperation, attorneys from Barristers LLP conducted a security training session for their colleagues at Evris Law Firm, during which they shared practical advice and their own experience interacting with law enforcement agencies during investigative actions as part of a pretrial investigation in criminal proceedings.
Oleksiy Shevchuk, Chairman of Barristers LLP, shared his experience communicating with the media during a search and developing an overall media strategy during a pretrial investigation, and outlined specific tools that can be used to create a positive media narrative regarding the client.
Partner Oleksandr Shadrin and Associate Partner Elvira Lazarenko discussed abuses by law enforcement officers during searches, provided practical advice on how to act during a search, analyzed investigative judges’ rulings granting search warrants, and shared examples from their own practice regarding effective measures to counter unlawful actions by law enforcement officials.
Attorney Oleksandr Tananakin outlined the steps company executives should take when receiving a request from law enforcement agencies pursuant to Article 93 of the Criminal Procedure Code of Ukraine. He explained how to respond to such requests and warned of the possible consequences of refusing to provide the requested information.
Attorney Iryna Kuzina discussed the procedure for summoning and questioning company employees during a pretrial investigation, outlined tactical approaches that can be used during such interrogations, and shared her own practical experience on minimizing the negative consequences a client may face as a result of giving testimony. Attorney Kateryna Danilova shared her experience in defending companies during tax audits and also highlighted recent changes in judicial practice regarding appeals against unlawful actions or decisions by tax authorities.
