Recently, NABU reported that it had uncovered a large-scale corruption scheme involving the misappropriation of funds from the state-owned enterprise “NAEK “Energoatom” during the construction of a critical infrastructure facility in the Mykolaiv region — the Tashlyk Pumped-Storage Power Plant.
Yuriy Radzievskyi, a partner at Barristers LLP, together with Vitaliy Chayun, an attorney at Barristers LLP, represented today before the High Anti-Corruption Court the interests of an individual whom anti-corruption authorities believe to be the organizer of the crime. The prosecutor insisted on pretrial detention with the right to post bail in the amount of 299 million hryvnias.
The defense argued as follows:
- the prosecution’s position is highly controversial, and the suspicion is not properly substantiated. The suspicion is based on speculation and unsubstantiated assumptions;
- the alleged damages are supported by a highly questionable forensic report;
- certain factual circumstances allegedly established by the prosecution were refuted by us using evidence submitted by the prosecutor to support his position;
- the risks of improper procedural conduct by the suspect are contrived and unsubstantiated;
- the bail of 299 million hryvnias requested by the prosecutor is exorbitant, excessive, and bears no relation to our client’s financial circumstances.
The court partially accepted the defense’s arguments, and the prosecutor’s motion was granted only in part. The suspect was remanded in custody, but the court set bail at 30 million hryvnias.
The bulk of the work lies ahead. The defense will continue to fight for justice.
