The lawyers at Barristers are representing the wife of Oleksiy Shcherbina, the volunteer who was shot. The
Holosiivskyi District Court of Kyiv has already imposed a preventive measure on the suspects in this crime. The court ruled that they be held in custody without the possibility of bail.
However, today, November 10, 2022, a hearing on the appeal was scheduled to take place. The
court session did not take place, as our attorneys were informed, because the court of first instance failed to forward the case materials.
The suspects remain in custody at the pretrial detention center; however, the decision of the Holosiivskyi District Court of Kyiv is still not final and could theoretically be overturned.
Meanwhile, the family of the deceased continues to feel uncertainty and fear for their own safety, not knowing whether their loved one’s killers will be imprisoned or not, since the case materials have not been transferred for the third week in a row, even though both courts are located in the same city.
This raises a logical question: Is this delay in the appellate review due to objective reasons, or does someone stand to gain from this delay? We still
hope that the courts will adhere to the principle of reasonable time limits in this case.
The attorneys working on the case are Barristers Constantine Globa, Andrii Yosypov, Viktor Yatsenko, and Bohdan Zabara.
