In the latest episode of the “Lawyer Online” video blog, Yuriy Radzievsky, a partner at Barristers LLP, comments on Deputy Minister of Justice Oleksandr Banchuk’s statement that Ukraine has committed to repealing the “Lozovoy amendments” by the third quarter of 2025.
What are the “Lozovoy amendments”? These are provisions of the Code of Criminal Procedure adopted in 2018, which require the mandatory dismissal of criminal proceedings if the prosecution violates the time limits for the pretrial investigation and files an indictment with a court outside its jurisdiction.
Yuriy Radzievsky explains: “It is precisely these amendments that implement the principle of reasonable time limits, recognized both in Ukrainian law and in the practice of the European Court of Human Rights. If the amendments are repealed, this principle will remain merely a declaration.”
What is the risk?
Without time limits, criminal proceedings can drag on for years, leaving people in the status of defendants for an indefinite period.
