The Dnipro Court of Appeals overturned the ruling imposing a preventive measure on the head of the Capital Construction Department of the Severodonetsk City Council
The appellate court granted the defense attorney’s appeal and overturned the ruling of the investigating judge of the Samara District Court of Dnipro, which had partially granted the motion filed by an investigator from the Main Directorate of the National Police in Luhansk Oblast to impose a preventive measure on the head of the Capital Construction Department of the Severodonetsk Municipal Administration in the Severodonetsk District of Luhansk Oblast.
According to the pre-trial investigation authority, during 2021, the actions of officials of the Engineering and Construction Department of the Severodonetsk Municipal Administration caused particularly large-scale losses to the state and local budgets while organizing work to restore the hydrological and sanitary condition of the Borova River in the Luhansk region, in connection with which, the head of the Engineering and Construction Department of the Severodonetsk Municipal Administration was notified of suspicion of committing a criminal offense under Part 5 of Article 191 of the Criminal Code of Ukraine.
On March 16, 2026, the pretrial investigation authority initiated a motion to impose a preventive measure on the suspect in the form of bail in the amount of 7,897,344 UAH, which was partially granted by the investigating judge, and a preventive measure in the form of a personal undertaking was instead imposed.
Disagreeing with this decision and considering the unfounded nature of the notice of suspicion, the suspect’s defense counsel filed an appeal. Following the review of this appeal, on April 13, 2026, a panel of judges of the appellate court issued a new ruling granting the appeal and overturning the order imposing the preventive measure.
