The attorney for the family of 5-year-old Kirill Tlyavov, who died, stated that they had not been informed of the change in the charges against the two police officers from the Pereyaslav-Khmelnytskyi Police Department.
Alexander Shcherbina, a lawyer with Barristers JSC, appeared on Channel 24 to thank the journalists who are taking an interest in this tragedy, unlike the State Bureau of Investigation (GBR), which ignores the victims’ representatives and the victims themselves.
By the way: The State Bureau of Investigation (GBR) has identified the killer of 5-year-old Kirill Tlyavov.
“As for the reclassification of the charges, I cannot comment on this in any way, since I am not aware of such a procedural action. As representatives of the victims, we were not notified in any way about the service of the amended charge, and unfortunately, we do not have such a procedural document,” explained Alexander Shcherbina, an attorney with Barristers JSC.
According to him, they repeatedly submitted relevant motions to the State Bureau of Investigation (SBI) during the pretrial investigation. However, these motions were also ignored by the pretrial investigation, and they were forced to appeal directly to the investigating judge regarding the SBI’s obligation to take certain actions.
“This really surprises me as a representative. Why does the pre-trial investigation agency perceive us as a threat?
” noted Alexander Shcherbina, an attorney at Barristers JSC.
Alexander Shcherbina added, “At the briefing, the head of the SBI reported that the charges had been reclassified under Article 119. Under this article, one suspect, who has already been identified, faces up to 5 years of imprisonment. There is also Part 4 of Article 296, which provides for a slightly longer sentence—up to 7 years in prison. But I am surprised by the SBI’s inaction regarding the investigation under Article 304—the involvement of a minor. Since we, as representatives of the victim, had filed a motion regarding this.”
