The National Bar Association of Ukraine has begun developing professional standards for the professions of “Attorney” and “Legal Assistant.” This initiative is being carried out in accordance with current legislation governing the development and implementation of professional standards and is aimed at establishing a regulatory framework for the content and structure of professional activities within the legal profession.
The purpose of developing these standards is to establish a systematically coordinated list of job functions, professional competencies, knowledge, skills, and abilities necessary for the proper practice of law and to ensure professional support for attorneys.
It is envisaged that qualification requirements will be formalized regarding educational level, practical experience, specialized knowledge in areas of law, adherence to the rules of legal ethics, standards of independence and confidentiality, as well as the establishment of criteria for evaluating professional practice.
The professional standard for the “Attorney” profession is designed to establish a competency model that encompasses the representation and defense of the rights and freedoms of individuals and legal entities, the provision of legal advice, the drafting of procedural documents, participation in judicial and extrajudicial proceedings, adherence to the safeguards of the legal profession, and ensuring an appropriate level of legal argumentation and the client’s legal position.

Special attention will be paid to requirements regarding continuing professional development, conflict-of-interest management, and adherence to standards of professional responsibility, ethics, and integrity.
The professional standard for the occupation of “Paralegal” will define the scope of functional duties, the limits of competence and reporting relationships, requirements for professional training, as well as a list of tasks related to drafting documents, providing analytical support for cases, and providing organizational and informational support for the attorney’s activities.
Establishing clear qualification requirements for this profession will facilitate a proper division of authority and improve the efficiency of work organization in law firms and associations.
Oleksiy Shevchuk, spokesperson for the Ukrainian National Bar Association (UNBA) and chair of the UNBA’s lobbying committee, and Serhiy Lysenko, Doctor of Law, Doctor of Science in Public Administration, professor, and academician of the Ukrainian Academy of Sciences, have been designated as the individuals responsible for developing the professional standards.
The involvement of other experts with a combination of practical and academic experience will ensure a comprehensive approach to shaping the content of the standards, taking into account the current requirements of legal practice and the development of Ukraine’s legal system.
It is expected that the adoption of professional standards will create a regulatory framework for improving educational programs for training lawyers, enhancing the professional qualifications of attorneys, unifying approaches to assessing professional competence, and strengthening quality assurance in the provision of legal services.
