Elvira Lazarenko, an attorney and partner at Barristers, LLC, and Alexander Tananakin, an attorney at Barristers, LLC, successfully defended the suspect —the head of the Capital Construction Department of one of Kyiv’s district state administrations—during the hearing on a motion to impose a preventive measure in the form of house arrest and removal from office.
The civil servant is suspected of committing a criminal offense under Part 4 of Article 191 (Embezzlement, misappropriation, or acquisition of property through abuse of official position) and Part 2 of Article 366 (Official forgery) of the Criminal Code of Ukraine.
During the court hearing, the defense attorneys demonstrated that the suspicion was unfounded and that there was no risk of obstructing the pretrial investigation.
Following consideration of the motion filed by the investigator of the Investigative Department of the Main Directorate of the National Police in Kyiv, the investigating judge of the Holosiivskyi District Court of Kyiv ruled to deny the motion to impose a preventive measure in its entirety.
Additionally, the investigating judge ruled to deny the motion to remove this individual from his current position.
