Alexander Shadrin, a partner at Barristers, LLC, spoke to the LHS audience about the agreement with the investigators

Oleksandr Shadrin, a partner at Barristers, LLC, delivered a presentation titled “The Nuances of a Plea Agreement” as part of the LegaL High School program.

A plea agreement between a prosecutor and a suspect or defendant is provided for in paragraph 2 of Part 1 of Article 468 of the Criminal Procedure Code of Ukraine.

The speaker highlighted the risks that may arise when entering into a plea agreement with the prosecution. For example, the court may refuse to approve such an agreement if there are grounds to believe that corruption is involved or if there are other suspicions regarding a violation of the right to a fair trial.

The speaker cited the savings in procedural time for the parties to the proceedings as a positive aspect of entering into such an agreement.

O. Shadrin emphasized the need to carefully review the terms of the agreement. In particular, a party to the agreement must be aware of the criminal liability for failing to fulfill the agreement. To this end, it is essential to clearly understand the timeframe within which you must fully fulfill your obligations.
