Victory on Appeal: The Illegality of the AMCU Fine in the Amount of 27,000,000 UAH Has Been Confirmed
The Northern Commercial Court of Appeals upheld the ruling that the decision by the Antimonopoly Committee of Ukraine to impose a fine on the company was unlawful.
By a decision of the Northern Commercial Court of Appeal dated October 1, 2024, the appeal filed by the Antimonopoly Committee of Ukraine (AMCU) against the decision of the Kyiv Commercial Court was dismissed.
Previously, the trial court had overturned the AMCU’s decision to impose a fine of 27 million UAH on our client for allegedly engaging in anti-competitive concerted actions while participating in public procurement.
Our law firm once again demonstrated in court the groundlessness of the Antimonopoly Committee’s claims and defended the company’s interests.
The courts of first and appellate instance agreed with the attorneys’ arguments that the actions of the participants in the public procurement process were not coordinated and therefore could not have resulted in a violation of the legislation on the protection of economic competition.
Following the successful review of the decision by the appellate court, the client’s right to participate in public procurement has been restored. This decision opens up new opportunities for the client to develop its business and collaborate with the government.
