The “Barristers” Law Firm and the All-Ukrainian Youth Public Organization “Law for All” are offering their colleagues a new mechanism for protecting their rights in their dealings with clients.

Sometimes a client, not understanding the specifics of a lawyer’s work, not grasping the complexity of certain legal proceedings, and failing to take into account the excessive caseload of the courts and, as a result, the lengthy duration of court proceedings, - may raise complaints against the attorney regarding the duration of their cases and/or the correctness of the attorney’s position, as well as the attorney’s compliance with the law and the Rules of Professional Conduct for Attorneys.

The “correctness” of a lawyer’s conduct and their compliance with the Law of Ukraine “On the Bar and the Practice of Law” and the Rules of Professional Conduct for Lawyers are assessed by the bodies of the bar’s self-governance.

However, questions remain regarding the legality and “ethicality” of a lawyer’s fee, a client’s unjustified failure to pay for legal services, and whether the fee is commensurate with the services actually provided.

An alternative for a swift and lawful resolution of such “misunderstandings” may be arbitration of a lawyer’s claims against a client, and, conversely, a client’s claims against a lawyer—conducted by experienced arbitrators (practicing lawyers) for whom the maximum protection of the client’s interests, the quality, and the integrity of the profession are fundamental principles.
