The Supreme Court granted the cassation appeal filed by Olena Semenyuta, an attorney at Barristers LLP, in a tax case, overturning the decision of the appellate court. Consequently, the decision of the Mykolaiv District Administrative Court, which had been rendered in favor of the business, remains in force.
The court of cassation fully confirmed the validity of the client’s business transactions with its counterparties, finding the tax authority’s conclusions to be unfounded. The tax authority had attempted to assess additional VAT and income tax liabilities totaling over 15 million hryvnias.
An important aspect of the case: Earlier, the team at Barristers LLP succeeded in obtaining a stay of the appellate court’s ruling until the conclusion of the cassation review, which protected the client’s assets from premature seizure.
