Case Won at the ECHR

The European Court of Human Rights has issued yet another ruling in favor of a client of BARRISTERS,
LLC. On July 6, 2023, the ECHR issued a ruling in the case of “SELEGEY AND OTHERS v. UKRAINE,” in which it found a violation of Article 5 of the Convention for the Protection of Human Rights and Fundamental Freedoms with respect to Ukrainian citizen Oleg Anatoliyovych LEGAN, due to his unlawful detention, for which the state is required to pay the applicant compensation in the total amount of 2,050 euros.
What made this case unique was that the individual was held in custody at the State Institution “Zhytomyr Correctional Colony No. 4” for 9 days while awaiting the receipt of a paper copy of the court decision ordering the applicant’s release from custody, despite the fact that an electronic copy of that document, sent by the court, had been available to them the entire time. 
Currently, the issue of appealing to the Ministry of Justice of Ukraine to bring the regulatory documents governing the procedure for releasing convicts from correctional facilities into compliance is being addressed, as well as the issue of appealing to law enforcement agencies to hold those responsible accountable.
