THANKS TO THE EFFORTS OF THE TEAM AT BARRISTERS, LLC On September 16, 2021, the Supreme Court upheld the appellate court’s ruling and the acquittal under Part 1 of Art. 201 of the Criminal Code of Ukraine—without any changes!

On September 16, 2021, through the efforts of Denis Ponomarenko, attorney and partner at BARRISTERS LLP, and Mykola Pashkovsky, attorney and research advisor at BARRISTERS LLP Mykola Pashkovsky—the Supreme Court, sitting as the Criminal Cassation Court, upheld the appellate ruling and the acquittal under Part 1 of Article 201 of the Criminal Code of Ukraine without any changes!

The Prosecutor’s Office (as established by the court’s acquittal—without grounds) had charged a U.S. citizen with transporting ammunition for firearms across Ukraine’s customs border while concealing it from customs control.

However, thanks to the coordinated efforts of the team at BARRISTERS Law Firm, on April 2, 2019, the Sykhiv District Court of Lviv (Case No. 522/1714/16-k, Case No. 1-kp/464/145/19), the U.S. citizen was found not guilty of the charge of committing the crime provided for in Part 1 of Article 201 of the Criminal Code of Ukraine, and was acquitted due to a lack of evidence proving the commission of the crime under Part 1 of Article 201 of the Criminal Code of Ukraine.

On October 21, 2019, by a ruling of the Lviv Court of Appeals (Case No. 522/1714/16-k, Proceedings No. 11-kp/811/406/19) the prosecutor’s appeal in the criminal proceedings against M.L. Petryshyn was dismissed, and the judgment of the Sykhiv District Court of Lviv dated April 2, 2019, was left unchanged.

The prosecution decided to further challenge the aforementioned judgment by filing a cassation appeal. However, thanks to the efforts of BARRISTERS Law Firm, on September 16, 2021, the Supreme Court, sitting as the Criminal Cassation Court, upheld the appellate ruling and the acquittal under Part 1 of Article 201 of the Criminal Code of Ukraine—without any changes!
