Automatic Acceptance of an Inheritance:
If you were registered at the same address as the decedent, you are automatically considered to have accepted the inheritance. In this case, if the probate case has already been opened, you do not need to file a declaration of acceptance of the inheritance.
You will only need to register the inherited property in your name after the 6-month deadline for accepting the inheritance has passed. This deadline is established in accordance with the Civil Code of Ukraine to allow other potential heirs to assert their rights.
Declaration of Acceptance of an Inheritance:
In other cases, you must file a declaration of acceptance of the inheritance.
You can file the application with a notary in your country of residence or at a Ukrainian consulate. It is generally easier to do so at a consulate, whereas filing with a foreign notary may require apostille certification.
The application must be submitted to the notary in Ukraine who opened the probate case.
If no probate case has been opened, a Ukrainian notary will open one based on the application for acceptance of the inheritance.
Registration of Inherited Property:
After the 6-month period has expired, you must register the property in your name.
This can be done by issuing a power of attorney to a person residing in Ukraine.
The authorized representative will be able to gather the documents and personally submit them for registration on behalf of the heir residing abroad.
