On September 20, 2018, the Kyiv City District Administrative Court granted the administrative claim filed by Ukrainian People’s Deputy Borislav Solomonovich Rosenblatt, which had been prepared by the “Barristers” Law Firm.
On September 20, 2018, the Kyiv City District Administrative Court granted the administrative claim filed by Ukrainian People’s Deputy Boryslav Solomonovich Rosenblat, which had been prepared by the “Barristers” Law Firm.
The court ruled that the actions of detectives from the National Anti-Corruption Bureau of Ukraine—coordinated with prosecutors from the Specialized Anti-Corruption Prosecutor’s Office of Ukraine—regarding the conduct of investigative operations in the form of:
1) an investigative operation—a controlled commission of a corrupt act within the framework of an investigative case, documented in a protocol based on the results of the investigative operation; - an operation involving the controlled commission of a corrupt act within the framework of the operational-investigative case dated November 23, 2016;
2) an investigative measure - covert identification and documentation of evidence of a serious or particularly serious crime, as well as documents and other items that may serve as evidence of the preparation or commission of a crime, within the framework of an operational-investigative case, documented in a protocol based on the results of the operational-investigative measure – the covert detection and documentation of evidence of a serious or particularly serious crime, documents, and other items that may serve as evidence of the preparation or commission of a crime, within the framework of the investigative case dated November 25, 2016;
3) an investigative operation—an operation involving the controlled commission of a corrupt act within the framework of an investigative case, documented in a protocol based on the results of the investigative operation – an operation involving the controlled commission of a corrupt act within the framework of the investigative case dated November 25, 2016;
4) an investigative operation—an operation involving the controlled commission of a corrupt act within the framework of an investigative case, documented in a protocol based on the results of the investigative operation – an operation involving the controlled commission of a corrupt act within the framework of the investigative case dated November 30, 2016.
In addition, the court ordered detectives of the National Anti-Corruption Bureau of Ukraine and prosecutors of the Specialized Anti-Corruption Prosecutor’s Office of Ukraine to comply with the requirements of current legislation regarding the observance of parliamentary immunity guarantees during criminal proceedings No. 42016000000003712 dated November 28, 2016.
