On December 12, 2018, a professional development seminar for attorneys will be held, focusing on the exercise and protection of human rights under martial law. The seminar is organized by the Committee on Constitutional Justice and Human Rights of the Odesa Regional Bar Association.

Iryna Hlovyuk, attorney, Doctor of Law, associate professor, and research advisor at BARRISTERS Law Firm, as well as a member of the Scientific Advisory Council at the Supreme Court, and Mykola Pashkovsky, Candidate of Law, associate professor, scientific advisor at BARRISTERS Law Firm, and a member of the Scientific Advisory Council at the Supreme Court, will address the following issues regarding the protection of the right to life under martial law:

  • procedural aspects;
  • the prohibition of torture and other cruel treatment under a state of emergency;
  • Are there any differences from peacetime?
  • how the defense should proceed under the special regime of pretrial investigation during martial law;
  • criminal proceedings in absentia.

2:15–3:00 p.m. FIRST MODULE.  MARTIAL LAW IN UKRAINE: LOCAL LEVEL Dmytro Terletskyi, attorney, Ph.D. in Law, Associate Professor, Chair of the Committee on Constitutional Justice and Human Rights Key Issues: the system of public authorities under martial law; interaction between military command and military administrations with public authorities under martial law; general characteristics of the legal regime of martial law.
3:00–3:45 p.m. MODULE TWO. SPECIFIC ASPECTS OF THE EXERCISE AND PROTECTION OF INDIVIDUAL RIGHTS AND FREEDOMS UNDER MARTIAL LAW.Alona Pavlenko, attorney, member of the Committee on Constitutional Justice and Human Rights Key issues: the procedure and grounds for restricting an individual’s personal, political, and socioeconomic rights and freedoms; the procedure and grounds for imposing obligations on individuals resulting from the imposition of martial law; compensation for damages caused during the imposition of martial law.
