Lawyers from the “Barristers” Law Firm continue to actively participate in the case of Oleksiy Shcherbina, a volunteer with the “Svoboda” Territorial Defense Forces who was murdered.
As a reminder, on October 21, 2022, Oleksiy Volodymyrovych Shcherbina was killed during a traffic altercation. After Oleksiy made a remark, three young men first beat the volunteer and then, after firing a gun, fled the scene of the crime.
According to public sources, the suspects in the case have criminal records, and one of them had an open criminal case at the time of the murder.
We recently received information that the investigation has classified the joint murder of Oleksiy under Part 4 of Article 296 (hooliganism) and the actions of one of the suspects under Part 1 of Article 115 (intentional murder) of the Criminal Code of Ukraine.
We note that our position regarding the involvement of all three perpetrators in Oleksiy’s murder remains unchanged, since the conflict and the moment of the murder occurred with the direct participation of all the individuals involved.
In our opinion, by classifying the case in this manner, the investigation is downplaying the role of the other two suspects and attempting to reduce the case to a domestic dispute, which it is not.
Given these circumstances, we have filed a motion to reclassify the actions of all individuals involved under paragraph 7 of Part 2 of Article 115 of the Criminal Code of Ukraine (murder committed out of hooliganism).
We emphasize that this case cannot be regarded as a mere conflict but represents a societal demand on the law enforcement system amid the ongoing war with the aggressor.
Fair punishment and a proper legal assessment of the violations committed against our defenders serve as a test of the state’s ability to fulfill its obligations and protect its own citizens.
Despite the mistakes made in the investigation, we will ensure that the investigators hear us.
