Denis Ponomarenko and Elvira Lazarenko, partners at Barristers LLP, have once again demonstrated the effectiveness of unconventional legal thinking. The attorneys secured the complete dismissal of criminal proceedings in which their client had long been listed as a suspect under Part 5 of Article 27 and Part 4 of Article 190 of the Criminal Code of Ukraine (fraud on an especially large scale).
During the pre-trial investigation, our client was groundlessly notified of suspicion. The attorneys succeeded in proving the absence of both the elements and the occurrence of a criminal offense.
Thanks to the defense’s consistent position and carefully prepared procedural steps, the investigation acknowledged that:
• the suspicion had been raised in error;
• the objective elements of fraud were not established;
• the individual’s actions did not constitute a criminal offense but were of a civil nature;
• Consequently, the notice of suspicion was removed from the Unified Register of Pre-trial Investigations, and the criminal proceedings were closed pursuant to paragraph 1 of Part 1 of Article 284 of the Criminal Procedure Code of Ukraine.
