Another successful outcome in the defense of a client who is a suspect under Part 5 of Article 190 of the Criminal Code of Ukraine was achieved by defense attorneys—Denis Ponomarenko, a partner at Barristers LLP, and Kateryna Varnaliy, an attorney at Barristers LLP
Case details: On October 3, 2025, an investigating judge of the Kyiv District Court of Odessa imposed a preventive measure on our client in the form of pretrial detention with bail set at 5,000 (five thousand) times the subsistence minimum for able-bodied persons, amounting to a total of 15,140,000 (fifteen million one hundred forty thousand) hryvnias.
The defense attorneys from Barristers Law Firm—D.V. Ponomarenko and K.O. Varnaliy—promptly appealed the ruling of the investigating judge of the Kyiv District Court of Odessa to the Odessa Court of Appeals. Thanks to a detailed analysis of the criminal case materials, a consistent legal position, and a clearly structured defense strategy, on November 5, 2025, the Odesa Court of Appeals ruled that the ruling of the court of first instance was unlawful, partially granted the defense attorneys’ appeals, and issued a new ruling.
As a result, the bail amount was reduced to 1,350 (one thousand three hundred fifty) times the subsistence minimum for able-bodied persons, amounting to 4,087,800 (four million eighty-seven thousand eight hundred) hryvnias.
Thus, the financial burden on the client was reduced by 11,052,200 hryvnias, which is a significant achievement in protecting his interests.
This case clearly demonstrates the importance of a lawyer’s professionalism, thorough preparation for court hearings, and the ability to resolutely defend the client’s rights at every stage of the legal process. This outcome is a striking example of how effective work by defense attorneys not only protects the client’s rights but also tangibly minimizes financial and legal risks, even in complex cases.
