On June 17, 2025, a panel of judges of the Kyiv Court of Appeals granted the appeal filed by attorney Oleksandr Shadrin on behalf of his client—a People’s Deputy of Ukraine, Sh.—to ensure that he could exercise his parliamentary powers.

By the court’s decision
: - the ruling of the investigating judge of the Shevchenkivskyi District Court of Kyiv dated March 4, 2025, which groundlessly returned the materials of the attorney’s motion to ensure the observance of the rights of a person in custody, was set aside;
- the case was remanded for a new hearing to the court of first instance;
- the ruling is not subject to appeal.

In its ruling, the court cited Articles 404, 407, and 422 of the Criminal Procedure Code of Ukraine, as well as the provisions of Article 206 of the Criminal Procedure Code, which guarantees the right to defense for a person in custody.
