AAU'S SECOND SUMMER FORUM, "GOLDEN DUKE": VIDEO RECORDINGS FROM SESSION 3: “HUMAN RIGHTS AND EVIDENCE GATHERING IN CRIMINAL PROCEEDINGS - AN ANALYSIS OF THE BALANCE IN INTERNATIONAL AND NATIONAL PRACTICE”

The third session of the AAU “Golden Duke” Summer Forum was devoted to human rights and the collection of evidence in criminal proceedings—an analysis of the balance in international and national practice.

On reasoned decisions and the evaluation of evidence when granting a search warrant: Oleksandr Drozdov, attorney, member of the High Qualification Commission of Judges of Ukraine, Honored Lawyer of Ukraine, Ph.D. in Law, and associate professor, discussed the relationship between national practice and the legal positions of the European Court of Human Rights.

Participants received practical recommendations on the application of human rights protection mechanisms under UN treaties in criminal proceedings from Boris Babin, Doctor of Law, Professor, and Scientific Advisor at Barristers Law Firm.

Lyudmila Volkova, managing attorney at Kinstellar International Law Firm, discussed aspects of defense in suspended criminal proceedings.

“Is non-instrumental lie detection an enemy or an ally during interrogation?” Valery Kipishinov, head of the OpenTruth profiling studio and advisor at MITRAX Law Firm, provided a detailed answer to this question.

Current legal issues regarding the appointment and conduct of forensic medical examinations—this was the topic of Boris Yavorsky’s presentation, a forensic medical expert of the highest qualification category, Candidate of Medical Sciences and head of the department of on-call forensic medical experts at the Odesa Regional Bureau of Forensic Medical Examination.

The session’s expert speakers were: Viktoria Smirnova, judge of the Criminal Chamber of the Donetsk Court of Appeals; Denis Ponomarenko, partner at Barristers LLP; and Mykola Pashkovsky, attorney and research advisor at Barristers LLP.
