The first episode features attorney Denys Ponomarenko’s argument before the Grand Chamber of the Supreme Court in the Logvynskyi case.
In his speech, the defense attorney emphasized that the ECHR’s ruling explicitly points to a violation of Mr. Logvinsky’s rights, and therefore the criminal proceedings must be dismissed. The attorney cited provisions of the Constitution, the Code of Criminal Procedure, and the Criminal Code of Ukraine that prohibit the criminal prosecution of individuals with diplomatic immunity, and emphasized that the decision of the European Court of Human Rights is a source of law and grounds for reviewing the case under exceptional circumstances.
