A court ruling has been issued ordering the retraction of false information regarding Mykola Povooznyk, First Deputy Head of the Kyiv City State Administration

Today, the Kyiv Court of Appeals upheld the ruling of the Dnipro District Court of Kyiv, which ordered Maksym Isanovych Bakhmatov to refute, no later than five days from the date this ruling takes legal effect, the false information disseminated regarding First Deputy Head of the Kyiv City State Administration Mykola Yuriyovych Povooznik, by posting it on the video-hosting website “YouTube” (https://www.youtube.com) on the “BAKHMATOV” YouTube channel (https://www.youtube.com/.../UCRJqGlStbRGlRgvD281.../featured) a video (with privacy settings in the “Visibility” section set to “Public”) titled “Refutation of False Information Regarding Mykola Yuriyovych Povooznyk” with the following content:

“I, Maksym Isanovych Bakhmatov, appeared on Sergey Ivanov’s program #Antipodes, a video recording of which was published on September 23, 2021, on the Internet on the video-hosting website ‘YouTube’ on the YouTubechannel ‘ISLANDIA (TV CHANNEL) / ISLND TV’ under the title ‘BAKHMATOV: When Kyiv Will Come to a Halt, Billions Wasted, Gray Klitschko, Comedy Club, Zelensky | ANTIPODES,” contained false information regarding Mykola Yuriyovych Povooznik, specifically:
“I, Maksym Isanovych Bakhmatov, on the program #Antipodes hosted by Sergey Ivanov, a video recording of which was published on September 23, 2021, on the Internet on the video-hosting website ‘YouTube’ on the YouTube channel ‘ISLANDIA (TV CHANNEL) / ISLND TV under the title ‘BAKHMATOV:
When Kyiv Will Come to a Halt, Wasted Billions, Gray Klitschko, Comedy Club, Zelenskyy | ANTIPODES,’ contained false information regarding Mykola Yuriyovych Povoroznyk, specifically:
 “And at the very moment when tough decisions really needed to be made—for example, there’s a suspicion that Povoroznyk took a $125,000 bribe in his office…”;
 ““Yeah, well, look at it now—you might not even remember, well, aside from Povoroznyk, who was caught taking a bribe… I’m telling you, we found out about him after he was caught taking a bribe.” 

The
court found that M.I. Bakhmatov publicly accused M.Y. Povoroznyk of committing a criminal offense (crime), liability for which is provided for by the Criminal Code of Ukraine. At the same time, the defendant was fully aware that the plaintiff was not a party to the criminal proceedings (neither a suspect nor a defendant); therefore, the defendant’s actions were not in good faith, and the information disseminated by the defendant was intended to undermine the honor, dignity, and professional reputation of the plaintiff, M.Y.
