Preliminary hearing in the case of O. M. Korniyenko: statements by the prosecutor, the victims’ representative, and the defense.

On December 22, 2018, the Bilhorod-Dnistrovskyi City and District Court of Odesa Oblast held a preliminary hearing in the case of O. M. Korniyenko, whose defense counsel is attorney and partner at Barristers Law Firm Denis Ponomarenko.

At that hearing, the panel of judges of the Bilhorod-Dnistrovskyi City and District Court of the Odesa Region granted the prosecutor’s motion to extend the term of the pretrial restraint measure in the form of pretrial detention against O. M. Korniyenko by 60 days. This was despite the fact that on Sunday, December 16, 2018, the defendant had already been ordered to be held in pretrial detention for a period of 30 days in the same case. At the same time, the panel of judges remanded the indictment on its own initiative. Although the defense objected to the remand of the indictment, since on December 6, 2018, in its judgment in the case of “Vega and Others v. Ukraine,” the ECHR had upheld the complaint filed by O. M. Korniyenko and found violations of Articles 6 and 13 of the Convention for the Protection of Human Rights and Fundamental Freedoms.
