Barristers JSC won a case seeking the return of a client’s funds in the amount of 3,032,000 hryvnias and 40,000 U.S. dollars, which had been unlawfully seized by detectives from the Economic Security Bureau of Ukraine (ESB).
Between February 1 and 7, 2023, UESB detectives conducted a search of non-residential premises at a manufacturing facility. As a result of the search, funds belonging to a third party—and having no connection whatsoever to the criminal proceedings investigated by the EBS—were seized.
The owner of the seized funds contacted the attorneys at Barristers Law Firm, and the attorneys obtained a ruling from the investigating judge, the execution of which resulted in the full return of the funds to the client of Barristers Law Firm on April 6, 2023.
In addition, the attorneys established that, in violation of the procedure for storing funds in criminal proceedings, the detective did not deposit the funds into the BEB’s deposit account but instead kept them on the premises of the pre-trial investigation agency, at his own disposal.
This situation revealed what the attorneys believe to be possible preparations for the unlawful misappropriation of funds by BEB employees.
