Rejection of the Motion to Recuse Mykhailo Holovko (AP VAKS)
The Appeals Chamber of the High Anti-Corruption Court upheld the lower court’s decision to deny the request to remove Mykhailo Golovko from office.
The court took a critical view of the prosecution’s position, which was based solely on the possibility of risks arising.
Specifically, the prosecutor failed to provide concrete evidence of such risks and confirmed the absence of any circumstances indicating unlawful conduct on the part of Mykhailo Golovko.
In turn, the defense attorneys provided evidence that Mykhailo Golovko had not exerted any influence on third parties and substantiated the legality of the trial court’s decision.
