The Kyiv Court of Appeals granted the defense’s appeal, filed by a team of lawyers from Barristers, and overturned the ruling to remove the director of one of the Dnipro City Council’s municipal enterprises from office.

A telling example is when the prosecution, in court, cites the following as grounds for its motion to remove the director:

- the risk of influencing the company’s employees (who may serve as witnesses),
- the destruction or tampering of documents.

The prosecution relied on these same hypothetical risks when filing its motion for pretrial detention.

Having failed to obtain a favorable ruling on the arrest—where the court had already determined there was no risk of influencing witnesses or destroying documents—the prosecution attempted to secure removal from office using the same arguments.

We view the BEB’s repeated use of arguments already rejected by the court as an attempt to exert pressure on the individual and to create obstacles to his employment and professional activities.
