Thanks to the efforts of the team at Barristers, LLC—partner and attorney Denis Ponomarenko and attorney Olga Blashchuk—the prosecutor’s appeal was dismissed, and the ruling closing the criminal proceedings under Article 284(1)(10) of the Code of Criminal Procedure of Ukraine was upheld.
On June 16, 2021, by a ruling of the Bilhorod-Dnistrovskyi City and District Court of Odesa Oblast (https://reyestr.court.gov.ua/Review/97756311), the criminal proceedings under Part 1 of Article 187 of the Criminal Code of Ukraine were dismissed at a preliminary hearing pursuant to subparagraph 10 of Part 1 of Article 284 of the Criminal Procedure Code of Ukraine.
In the aforementioned proceedings:
1. The failure to meet the deadlines for the pretrial investigation was established by four rulings of investigating judges;
2. The indictment was drafted, signed, and submitted to the court two years after the expiration of the pre-trial investigation deadlines;
3. However, the Bilhorod-Dnistrovskyi District Prosecutor’s Office filed an appeal, citing the two days that allegedly remained until the end of the pretrial investigation period, and then went so far as to claim that the court lacked the authority to dismiss the criminal case during the preliminary hearing.
But thanks to the joint efforts of the “Barristers” team—specifically, partner and attorney at “Barristers” Denys Ponomarenko and attorney at Olga Blashchuk, on November 25, 2021, the Odessa Court of Appeals put an end to this case and issued a ruling dismissing the prosecutor’s appeal, and the ruling of the Bilhorod-Dnistrovskyi City and District Court of Odesa Oblast dated June 16, 2021, to dismiss the criminal proceedings, was upheld.
